Brazil sets November hearing on Lula’s betting ban
Brazil’s Supreme Court has scheduled a hearing on Lula’s fixed-odds betting ban. Payment providers must distinguish the next judicial milestone from permission to resume processing, while keeping customer refunds and outstanding obligations on track.

What changed
On 27 October, Brazil’s Supreme Federal Court announced a public hearing for 3 November at 10:00 Brasília time. Justice Luiz Fux scheduled it in ADI 8027, a challenge to President Luiz Inácio Lula da Silva’s Provisional Measure 1,394/2026. The hearing brings public authorities, industry representatives and football clubs into the debate. The published hearing order does not decide the request to suspend the measure. [02A]
The measure, signed on 25 September, prohibits fixed-odds sports betting and online games, including offers from overseas operators to people in Brazil. Other lottery modalities permitted by law are excluded. Article 14 restricts financial institutions, payment institutions and payment-arrangement participants, including instant-payment participants, from processing, settling or enabling covered transactions. It expressly preserves transactions necessary to close operations and return money to bettors. [02B]
The Finance Ministry’s guidance, updated on 26 October, sets 15 December for regularising financial and regulatory obligations from the operating period and transition, subject to specific deadlines. Ending authorisations does not erase existing obligations. Operators must maintain current contact details and a legal representative to handle outstanding matters. [02C]
The next court milestone
The hearing is scheduled; its outcome remains open.

TopPay analysis
A hearing changes the review calendar. Payment controls change when an applicable legal decision changes what a transaction is allowed to do.
For payment operations, the hearing creates a review point. Teams still need a documented basis for each processing decision: the legal act, its effective date, the entities it covers and the activity it permits. A hearing announcement alone cannot supply those instructions.
The practical distinction is transaction purpose. Returning an existing customer balance and funding new betting activity require different controls under the measure. Any later court decision needs to be translated into precise processing rules while preserving the record of earlier refunds and exceptions.
Operational focus
Verify the legal trigger
Record the operative document, affected operator and payment activity before changing a route. Separate an application for relief, a scheduled hearing and a binding decision in the approval record.
Keep refunds traceable
Connect each permitted return to its customer, source balance, operator and receiving account. Reconcile completed refunds separately from failed transfers and amounts still requiring resolution.
Retain ownership of the closure
Assign an owner to outstanding balances, reporting and partner dependencies. Maintain a dated change log so any future adjustment can be implemented without losing the history of the closure.

What to watch
Watch the 3 November hearing and any subsequent published decision. Separately, Congress lists 9 November for urgency procedures and 23 November as the end of the initial deliberation period. These procedural dates do not automatically authorise services to resume. [02A] [02D]
