Brazil court development keeps refund reconciliation in focus
Stake Brazil’s temporary court protection was suspended, while the betting wind down still requires careful handling of customer balances.

The latest court development
On 9 October, Brazil’s TRF3 suspended the injunction that had allowed Stake Brazil to continue operating temporarily until 25 October. The decision removes that interim protection; it does not finally determine the constitutionality of Provisional Measure 1,394/2026. [05A]
The measure’s Article 14 restricts covered betting payment flows while excepting transactions necessary for closure and restitution. The Finance Ministry scheduled bank refunds for 9 to 14 October, with Caixa involvement where operational difficulties prevented returns. A timetable does not prove every refund was completed. Court events and statutory milestones
An operator-specific interim decision sits within a wider wind-down timetable.
- MP 1,394/2026 published
- Sites and apps required to close
- Stake interim protection suspended
- Authorisation termination milestoneScheduled / target
Selected milestones, not to scale. The 6 October item is a requirement, not evidence of an observed shutdown. The 25 October milestone is still scheduled at review. [05A][05B][05C]
TopPay analysis
A refund timetable is not a completion record. Keep balances, available funds and confirmed transfers reconciled.
Payment teams still need to match the customer balance owed with the money available and the transfer actually completed. A failed refund should remain identifiable until its outcome is resolved, even after a scheduled payment window has passed.
Permitted closure transactions also need a documented purpose. A court headline concerning one operator cannot establish permission for another business or for a different transaction. Review depends on the written order and any later suspension, rather than the existence of litigation alone.
Three records for refund reconciliation
Keep unresolved items visible after a scheduled refund window ends.
Balance owed
Record the amount due to each customer.
Funds available
Match the obligation to available money.
Transfer confirmed
Resolve failed or unconfirmed returns.
TopPay analysis: an illustrative record model, not evidence that any customer refund has been completed.
What to watch
As reviewed on 23 October, the congressional record still shows the measure awaiting committee installation. The statutory authorisation termination milestone is 25 October. Follow later court orders and official legislative updates, while keeping unresolved restitution items visible. [05B][05D]
